General conditions of Sale
These general conditions of sale (hereinafter, "General Conditions") have as their object the regulation of the purchase of products, carried out remotely and made available, via the internet, from the site www.caramiabeautylab.it (hereinafter, the "Site") in compliance with the Italian legislation referred to in Legislative Decree 206/2005 and subsequent amendments and additions (hereinafter, the "Consumer Code"). The seller of the products and owner of the Site is CaraMiaBeautyLab di S.A. Caramia located in via Grazia Deledda 44 - 70043 Monopoli (BA). P.IVA: 08586610720.
The consumer who accesses the Site to make purchases (hereinafter "Customer") is required, before sending the order, to carefully read these General Conditions that have been made available to him on the Site.
Terms and conditions
Prices, content and availability of products
The characteristics of the products are indicated in the online catalog and are visible at the time of choosing and filling out the order before the conclusion of the forwarding procedure. The images shown on the website are entirely indicative and could also differ significantly from the product actually available. The products may undergo changes following updates or production needs relating to: packaging for packaging, labels and contents. The prices (inclusive of VAT and all other taxes and duties) are indicated next to each product in the online catalog.
The prices and availability indicated in this catalog are intended as long as stocks last and are subject to changes due to production or other reasons. Discounts, coupons and promotions are never combined.
Shipments of particularly heavy or bulky products
In the case of orders regarding particularly heavy or bulky products that therefore require the shipment of several packages, CaraMiaBeautyLab reserves the right to call the user at the address indicated at the time of the order - or to write to the e-mail address indicated - to notify any adjustments in shipping costs for extra packages.
Validity of prices and order confirmation by e-mail
By submitting the order request you will receive an automatic confirmation by e-mail. This order confirmation has the sole purpose of notifying the receipt of the electronic order and does not constitute formal acceptance of the order. The price applied will be the one fixed at the time of the order. IS however, it is possible that some offers or items are in the meantime sold out or have undergone particularly significant price changes. In this case, we reserve the right to contact you as soon as possible to cancel the order (without penalties for both parties) and possibly offer you an alternative product.
Responsibility
CaraMiaBeautyLab assumes no responsibility for the use that the customer intends to make of the purchased goods. In case of defective or non-functioning goods CaraMiaBeautyLab will have the sole burden of replacement at its discretion. In no case CaraMiaBeautyLab will be held responsible for lost earnings due to the inability to use the products purchased.
Order fulfillment:
Unless otherwise indicated, we reserve the right to send available products by refunding or removing products not in stock from the order. If, on the other hand, the partial evasion is explicitly requested by the customer, he will have to bear the burden of the additional shipment.
The lack of products or parts of them in the package must be declared within two days of receipt of the package (also by e-mail). In the event of any impossibility, even temporary, to process the order partially or totally, CaraMiaBeautyLab will promptly send an e-mail to make arrangements with the consumer, without prejudice to the possibility for the consumer to request cancellation, even partial, of the order and the refund of the corresponding amount already paid. If the user's data are incomplete or in any case inaccurate (so as to make delivery of the package impossible), CaraMiaBeautyLab will contact the user himself before fulfilling the order.
Delivery methods and times
CaraMiaBeautyLab ships by Express Courier, which has always offered a fast and guaranteed service. CaraMiaBeautyLab assumes no responsibility for damage caused to the goods, caused by the conditions or methods of transport / delivery adopted by the designated courier.
Average processing times are 2-5 working days but delivery times may vary due to force majeure such as weather conditions and strikes.
Deliveries are made from Monday to Friday, during normal office hours, excluding national holidays, by delivering the products to the address specified when placing the order.
It is very important, during the purchase phase, to indicate a valid e-mail address, in order to allow the Courier to communicate the taking charge of the shipment and thus optimize the delivery methods.
Shipping cost
CaraMiaBeautyLab applies the following shipping costs valid only for Italy:

Shipping costs for Great Britain are € 32.00.
The price that will be invoiced is the one present next to the product at the time of the conclusion of the order in addition to the shipping costs contribution, without taking into account any subsequent updates. CaraMiaBeautyLab reserves the right to change the prices of the products and the shipping costs without prior notice. Any new amounts will be effective from the moment they are published on the CaraMiaBeautyLab.it website and will be applied to sales made from that moment. CaraMiaBeautyLab will send, after the conclusion of the order, an automatic e-mail confirming receipt of the order. The consumer is invited to print the e-mail and to keep it. If the consumer does not receive it, please contact CaraMiaBeautyLab.
If a disservice or delay in delivery is detected, the consumer can report it to the following e-mail address info@caramiabeautylab.it.
Payment methods and terms
The following payment methods are allowed on the Site:
- Advance bank transfer
At the same time as the automatic e-mail confirming receipt of the order, we will send the details for the bank transfer to be made before the departure of the goods. The order will be processed by CaraMiaBeautyLab upon receipt of the bank transfer. Inside the package will be inserted a transport document or (if required) the accompanying invoice relating to the order, with the details of the products purchased and their prices.
- PayPal
The charge will be made only after (i) the details of your payment card used for payment have been verified and (ii) the company issuing the payment card you used has issued the authorization to charge.
In application of Directive 2015/2366 / (EU) on payment services in the internal market (PSD2), the user is informed that he may be required to complete the purchase process by satisfying the authentication criteria required by the payment institution in charge of manage the online payment transaction. The authentication criteria refer to the user's identity (to satisfy this criterion the user must be registered on the Site during the purchase operation) and to the contextual knowledge of the authentication code transmitted by the payment institution (Strong Customer Authentication ). Failure to complete the procedure described above may imply the impossibility of finalizing the purchase on the Site.
The confidential data of the payment card (card number, holder, expiration date, security code) are encrypted and transmitted directly to the payment manager without passing through the servers used by the Seller. The Seller therefore never has access to and does not store, even if you choose to store such data on the Site, the details of your payment card used to pay for the Products.
The charge will be made at the time of order transmission.
Coupon e Gift Card
Coupons are issued by CaraMiaBeautyLab (or by partner sites), allow you to take advantage of a discount on purchases made on www.caramiabeautylab.it
Once the items have been added to the cart, enter the Coupon in the "Apply discount code" box, ending on "Apply discount", or the Gift Card in the appropriate "Gift Card" box, then the "Add Gift Card" action follows. The discount code may only apply to items included in the promotion used.
Discount codes are issued in the form of an alphanumeric code and their value (in euros) is established unquestionably and at its total discretion by CaraMiaBeautyLab. The discount code entered in this way will be automatically deducted from the total amount of the order before payment, excluding any shipping costs. Discount codes are generally usable by the user for a limited period of time, after which they will no longer be usable. Discount codes may be subject to a minimum amount of expenditure under which their use will not be possible.
Unless otherwise specified, the discount code is personal and linked to the User's Account and can be used for a single purchase, after which it will be automatically invalidated.
Discount codes and Gift Cards cannot be combined. They cannot be sold, sold and / or transferred to third parties except with the express authorization of CaraMiaBeautyLab. CaraMiaBeautyLab reserves the right to cancel any previously issued discount code, even before the expiration date, without having to justify the reason and without the right to indemnity or compensation. CaraMiaBeautyLab reserves the right to delete coupons issued in favor of users who make an improper use, without notice and without the right to indemnity or compensation.
The amount of the various coupons cannot be divided into multiple orders, each coupon can only be used on a single order.
Limitations on the use of the coupon:
The coupon can be used only once unless otherwise indicated by CaraMiaBeautyLab. The coupon cannot in any way be converted into cash. Coupons cannot be combined.
Right of withdrawal
The consumer has the right to withdraw from the contract, without indicating the reasons, within 14 days. The withdrawal period expires after 14 days from the day on which the consumer or a third party, other than the carrier and designated by himself, acquires physical possession of the last good. To exercise the right of withdrawal, it is necessary to inform us of the decision to withdraw from this contract by means of an explicit declaration. To this end, you can use the Returns and Refunds form which will be sent by e-mail in response to the report by the consumer. To meet the withdrawal deadline, it is sufficient to send the communication concerning the exercise of the right of withdrawal before the withdrawal period has expired.
In the event that the product is deteriorated or damaged, for reasons not related to transport, CaraMiaBeautyLab will refund the product but, possibly, at the price decreased by the depreciation caused by the customer. The consumer is only responsible for the decrease in the value of the goods resulting from the handling of the goods other than that necessary to establish the nature, characteristics and functioning of the goods.
Effects of withdrawal
If the consumer withdraws from this contract, he will be given a reimbursement of expenses by bank transfer addressed to the IBAN indicated in the withdrawal form or he will be given a shopping voucher to be used exclusively for purchases of products of the same amount from the caramiabeutylab e-commerce site. .it, including delivery costs (with the exception of additional costs deriving from the possible choice of a different type of delivery) without undue delay and in any case no later than 14 days from the day on which we are informed of the decision to withdraw from this contract. The voucher can be used over a period of three months. The voucher will be suspended until the damaged goods are received and returned by the consumer. Please return the goods to CaraMiaBeautyLab di S.A Caramia Via Grazia Deledda, 44 - 70043 - Monopoli (BA) without undue delay and in any case within 14 days from the day on which you communicated your withdrawal from this contract. The deadline is met if the consumer sends back the goods before the expiry of the 14-day period. The direct costs of returning the goods will be borne by the consumer.
Exclusions from the right of withdrawal
The following are excluded from the possibility of exercising the right of withdrawal:
- the supply of unsealed goods which are not suitable for return for hygienic reasons or related to health protection and have been opened after delivery;
- the supply of goods which, after delivery, are, by their nature, inseparably mixed with other goods.
The right of withdrawal provided for in the Consumer Code concerns only the consumer. The notion of "consumer" is provided for by art. 3 lett. A Legislative Decree 206/05: "consumer or user: the natural person who acts for purposes unrelated to any entrepreneurial, commercial, craft or professional activity carried out". Therefore, being the holder of a VAT number a professional, and not a consumer, he will not be able to exercise the right of withdrawal governed by the Consumer Code.

Applicable law and competent court
The sales contract between the customer and CaraMiaBeautyLab is concluded in Italy and governed by Italian law. For the solution of disputes relating to the interpretation, execution or resolution of these General Conditions or individual purchase orders if the Customer is a consumer pursuant to the Consumer Code, the court of his / her town of residence or of domicile if located in the Italian territory; in all other cases, the territorial jurisdiction is exclusively that of the Court of Bari, any other competent court excluded.
Information for the protection of privacy
CaraMiaBeautyLab is committed to protecting the privacy of its customers, considering the personal information provided by the customers as confidential. The information is used solely to ensure that the purchase of the goods proceeds in the best way.

CaraMiaBeautyLab informs that the personal data, provided by filling in the "personal data" form or in any other way, are processed in accordance with Law no. 196/2003. These data remain available to the consumer for verification, modification or cancellation (by entering the Personal Data Sheet) and for the exercise of any other right provided for by articles 7,8,9 of Legislative Decree 30 June 2003, n.196. The data is entered in a customer database at the time of the first order or registration. With reference to such data, CaraMiaBeautyLab communicates that: the collection and processing of consumer data are necessary if he wants to place an order for products or to access particular services (in this case a refusal by the consumer would make it impossible to evasion of the order or access to the service). Their processing will take place in relation to contractual requirements, including the operations of payment, payment and delivery of the products ordered, to fulfill obligations established by law or ordered by the Authorities and, upon explicit authorization, for purposes of interactive commercial and promotional information and for market research. Consumer data may be communicated to CaraMiaBeautyLab employees, consumer data will not be disclosed or communicated to third parties who are not CaraMiaBeautyLab employees, except to subjects necessary or functional for the performance of the contractual activity: Banking institutions for the management of payments and freight forwarders for the transport, in the place indicated by the consumer, of the purchased products, third parties who provide activities and services necessary for the execution of the services that the consumer will have deemed necessary to request and / or authorize the consumer's data to CaraMiaBeautyLab, unless otherwise provided , will be communicated to the person to whom he has decided to send one or more products purchased through CaraMiaBeautyLab as a gift.
